Cargo bike rental

Our cargo bike is intended to strengthen the sustainability of the university and the Hochschulwerk and serve as a means of transportation for the building services and Café Larix, for example. It will also be available to the community as a common good. As an alternative to the car, cargo bikes can be used for sustainable transportation - we are therefore advocating a rethink of urban mobility. We want as many people as possible to try out the use of cargo bikes in cities and thus become multipliers themselves.

Why does it cost nothing? The purchase of the bike was kindly sponsored by Stadtwerke Witten and supported by the state of NRW. The running costs are borne by the university and the Hochschulwerk. This means that everyone can borrow one - regardless of their budget.

If you would like to hire the bike, please fill in the form below. We will then contact you by email to arrange collection and return. The bike is normally parked at Café Larix, other handover locations can be arranged on a case-by-case basis.

In principle, you can borrow the bike for any period of time, but please note that it is also used to transport goods for the university and Café Larix and that many people are interested. We therefore reserve the right to limit the rental period if necessary.  Usual rental periods are, for example, half a day or over the weekend.

Please return the bike in good time and allow enough time to charge the battery. You may also need to borrow the charger.

Please remember to bring your identity card with you when borrowing.

The bike is in use and may be damaged. Scratches do not mean a broken frame! It is important that the team is informed of any damage. Especially if the bike becomes unroadworthy and cannot be repaired before the next use. This way we can cancel the following reservations.

If the bike can still be transported without endangering other road users, bring the bike back to the station. You may find a repair kit and rudimentary tools in the emergency bag on the bike. If the bike can no longer be ridden, please lock it to a fixed object. Make sure that it is not in the way and not on private property.

In any case, please inform the team so that the damage can be repaired and transport can be organized.

In any case, you don't have to learn how to ride a bike from scratch. If you can ride a normal bike safely, you'll find your way around the cargo bike after a few hundred meters of familiarization, especially as our model is a longtail.

If you haven't ridden an e-bike before, consider the higher average speed. Especially when heavily loaded, you have a bit of a braking distance and a cargo bike also has a larger turning circle and cornering radius.

If you want, you can get a short introduction and ask questions when you borrow the bike or take a test ride around the university.

As a user, you are liable for damage to the bike (excluding wear and tear) and to third parties during the rental period. Even in the event of loss. Therefore, remember to always lock the bike to a fixed object and, if possible, do not leave it on the street at night.

The liability of the borrower is limited to gross negligence and intent (see also terms of use). This means that you are responsible and can be held responsible.

Foreword

The free cargo bike is a free offer from Witten/Herdecke University and the Hochschulwerk e.V. We want to enable mobility in the city without a car and encourage members of the university to get around in a climate-friendly way. The terms of use stated here apply to the Yuba “Spicy Curry” e-cargo bike.

We ask you to handle the cargo bike as carefully as possible so that it is available to as many people as possible for as long as possible. These terms of use are intended to support this concern.

General information

  •  The conditions stated here apply to the rental of a cargo bike (hereinafter referred to as “bike”) from the registered association with the name Hochschulwerk Witten/Herdecke e.V., register entry: VR 10 621 at Bochum District Court (hereinafter referred to as ‘provider’) to registered users (hereinafter referred to as “user”). The principles of this loan are regulated herein.

  • Deviating regulations are possible by mutual agreement. By making use of the loan of the aforementioned bicycle, the user agrees to the terms and conditions of business and use stated here or on the bicycle for the agreed duration of the loan.
  • At no time does the user acquire ownership rights to the bicycle. The personal data requested during registration must be completed truthfully. All data collected will be processed and used exclusively within the project and will not be passed on to third parties

Rules of use

  • Each user is responsible for the bicycle for the duration of the rental period. This also applies if the bicycle is loaned to a third party during the rental period.The provider does not guarantee that the bicycle is in a proper, roadworthy condition.
  • The user must check that the bicycle is roadworthy and fit for use before starting the journey. This also includes checking the lights at dusk or in the dark. If the bicycle has a defect that affects road safety, this must be reported to the provider immediately. The bicycle may not be used in this case.
  • The bicycle is provided by the provider free of charge. Subletting by the user is not permitted.
  • The user is obliged to use the bicycle exclusively in a proper manner (cf. §603 BGB and see instructions for use) and to observe the applicable road traffic regulations.

When not in use, the bicycle must be secured against easy removal using the lock provided when the bicycle was rented. This means that it must be locked to a fixed object. This also applies to short absences.

  • Should it nevertheless be stolen, the user shall immediately report the theft to the police and contact the provider.
  • The user is prohibited from modifying the bicycle.

Liability

The provider's liability for the use of the bicycle is limited to gross negligence and intent (see §599 of the German Civil Code). This does not apply to damages resulting from injury to life, limb or health caused by a negligent breach of duty by the provider or an intentional or negligent breach of duty by a legal representative or vicarious agent of the provider.

The user shall be liable for all changes or deterioration to the bicycle if these are due to use not in accordance with the contract. In addition, the user shall also be liable for the loss and destruction of the bicycle or individual parts thereof.

Reservation

The provider reserves the right to discontinue lending without giving reasons or to prohibit individual persons from doing so.

Data protection

All personal data that we collect is used for the smooth running of the rental service and is processed exclusively by Hochschulwerk Witten/Herdecke e.V.. Your data will not be passed on to third parties. The only exception is in the event of damage, in which case we must share information with our insurance company. In this case, we reserve the right to pass on data to Witten/Herdecke University and the insurance company.

Your data will be stored for a maximum of three months from the return of the bike if everything is in order. In the event of damage, the data will be stored for a maximum of one year after all insurance matters have been settled.

You can request an export of your personal data from us at any time, including all data that you have provided to us. This does not include data that we are required to keep for administrative, legal or security reasons.
